Setting Up California Overtime

California has some very interesting overtime provisions that go beyond those required by the FLSA (Fair Labor Standards Act). Nonexempt employees that work more than 8 hours in any workday or more than 40 hours in any workweek need to be compensated at 1.5 times their regular rate of pay. In addition, employees are to receive 1.5 times their regular rate of pay for the first 8 hours worked on the 7th consecutive day of work in a workweek. This last provision is the one that makes tracking California overtime so difficult. California also requires double the employee's regular rate of pay for all hours worked over 12 in any workday and for all hours over 8 on the 7th consecutive day of work in a workweek.
